Public Sector Equality Duty (PSED)

Section 149

Public Sector Equality Duty (PSED), Section 149

Summary

Section 149 of the Equality Act 2010 says that public authorities – and any organisations carrying out public functions – must think about equality when they make decisions or deliver services. They must have ‘due regard’ to three aims: removing discrimination, improving equality of opportunity, and encouraging good relations between people with and without protected characteristics.

Key Points

  • Applies to public bodies and organisations that perform public functions.
  • Requires ‘due regard’ to three aims:
    • removing discrimination, harassment, victimisation and related conduct
    • improving equality of opportunity, including reducing disadvantage and encouraging participation
    • promoting good relations and tackling prejudice
  • The duty is about how decisions are made. Public bodies must consider equality when planning or delivering services, but the law does not require specific outcomes.
